Tree Consents

Some trees in Whakatane District are protected under the District Plan because of the type of tree (species), location or size.  Trees are enjoyed by many, make our district look great, and they can improve land value. We encourage landowners to take care to protect trees where possible.

Size of trees protected

Native trees standing higher than 8m and exotic trees standing higher than 12m are protected. In both cases, trees with a trunk circumference of more than 0.5m at a height of 1.4m are protected.

Removing a tree on your property

It’s free to apply to remove a tree. You can download an application form (PDF, 112Kb) or pick up a copy from the Council. Once you have applied a Council staff member will come out and assess the tree based on a set of criteria. If the tree scores poorly, you will receive a letter with consent to remove the tree.

If the tree receives a high score, Council staff won’t support the removal of the tree. Additional information will be required to support your application – such as an aborist’s report. In some cases a Council Hearing will be held to decide if the tree can be removed.

Evidence to support your application

You should provide evidence to support your application to remove a protected tree, such as:

  •  photographs of damage, such as broken paving
  •  invoices for remedial work, such as broken sewer lines or pruning for powerlines
  •  building plans
  •  professional arborist’s report
  •  written neighbours’ complaints.

All trees require maintenance and pruning to keep them healthy and safe. Property owners are responsible for keeping their trees well maintained and safe.
