Proposed Whakatāne District Plan - submissions and hearings

Hearings to the Proposed Whakatāne District Plan were undertaken in two phases. The first phase took place from April to June 2014, and the second phase took place from July 2014 to May 2015.

The consultation process has finished, and the Plan was made Operative in July 2017.

The District Council notified the summary of decisions requested in submissions and made it available for inspection on 22 November 2013, with further submissions closing 19 December 2013.

Due to a Council processing error, submissions 71 and 75 were removed from the summary and a new summary prepared. The new summary was re-notified from Wednesday, 15 January 2014, and further submissions closed 5 pm, 30 January 2014.

Opportunity for submitters to make further submissions supporting or opposing the original submissions received

Hearings
A planning report will be prepared for the hearing, which will consider all submissions and provide recommendations to the hearing panel. The public hearing will provide an opportunity for submitters to orally present their submissions.

Decisions
Following the public hearing, the hearing panel will deliberate and reach decisions considering all information/evidence presented orally and in written form. The decisions will address the submissions made. The decisions when made will be publicly notified.

Appeals
Once the decision has been issued and publicly notified, submitters have the opportunity to lodge appeals with the Environment Court if they are not satisfied with the Council's decision and to support or oppose another submitter's appeal that is on the same subject matter as their submission.

Plan made Operative
Appeals to the Environment Court can be resolved in a variety of ways, including through assisted mediation and hearings. Once appeals have been resolved, the Proposed District Plan can then be made operative.
