Competition Terms and Conditions

At times, Whakatāne District Council including, but not limited to, its community facilities, museums, libraries and aquatics centres will run competitions. By entering a competition, entrants are deemed to have read, understood and accepted the following general Terms and Conditions. These Terms and Conditions apply unless otherwise stated.

Competitions

  1. Winners are selected either by random electronic selection from all valid entries or, by random prize draw from all print entries.
  2. Entries received before a specified commencement date or after a specified closing date will not be accepted.
  3. Every entrant warrants that all information submitted is true, current and complete. Whakatāne District Council reserves the right to disqualify any entrant who does not comply with these terms and conditions.
  4. Competitions are open to Whakatāne District residents, aged 18 years and over, unless otherwise stated.
  5. A person can only enter once unless otherwise stated.
  6. Whakatāne District Council is the organiser of these promotions, they are not in any way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, Twitter or any other social channel used to promote the competition.
  7. Entrants agree to release Facebook, Instagram, Twitter or any other media channel from any and all claims and demands arising out of, or in connection with, their participation in any promotions or with any of the prizes offered. 

Entries, selection and prizes

  1. If you are the winner of a competition, Council will make reasonable efforts to contact you within 5 days of the draw, using the contact details provided in your entry form. If for any reason Council is unable to make contact with you within that period, the prize will be forfeited and another winner will be drawn on the same terms and conditions as the original draw.
  2. Prizes are not redeemable for cash, transferable to any other person, and cannot be used in conjunction with any other offer or promotion.
  3. If a prize or part of a prize becomes unavailable (for any reason), Whakatāne District Council reserves the right to limit entry, cancel or amend the prize at its own and sole discretion, including providing the winner with a substitute prize, either in full or in part.
  4. The selection results are final and no correspondence will be entered into. Subject to any applicable laws which cannot be excluded, Council, its employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with any competition or with winning, redeeming or benefiting from the prize.
  5. In the instance a winner is drawn and announced via Council social media channels, and said winner does not claim their prize within 5 working days, a new winner will be drawn and any previous winner will forefit their prize.
  6. It is the Council's sole discretion to remove the offer of a prize in the instance that an initial, or any subsequesnt prize draws, do not result in a prize being claimed i.e. prize winners will not be drawn ad nauseam and Council reserve the right to close any competition without a prize being successfully awarded.
  7. Previous winners will not be eligible to enter for a period of 90 days.
  8. Council reserve the right to cancel a promotion at any time and at their own discretion, and correspondence will not be entered into. 

Future Promotion & Privacy

  1. By entering the competition, you, the entrant, agree to the use of your name and/or image/video/content for publicity and promotional purposes both now and in to the future, without compensation by Whakatāne District Council.
  2. Council may request to take and use a photo of the prize winner to be used for promotional purposes - and this is a requirement to claim a prize at Council's sole discretion.
  3. All information provided by the entrants will be collected, used, stored, disclosed and corrected in accordance with the Privacy Act 1993. All entrants have the right to access their information and request for any personal information to be corrected.

Exclusions

  1. The following persons are not eligible to win any competition:
    • a) Anyone who works for Whakatāne District Council or is an Elected Member of the Whakatāne District Council.
    • (b) The immediate family of the council department running the specific competition e.g. 'Communications and Engagement', 'Places & Open Spaces', 'Strategy and Community Development Team' etc.
    • (c) Any agencies, companies or other third parties associated with the competition.
  2. Whakatāne District Council reserves the right to exclude any entrant from participating at its sole discretion. Whakatāne District Council also reserves the right to refuse to award a prize to an entrant who is in breach of these Terms and Conditions, gained an unfair advantage in participating, or has won by using fraudulent means.
  3. Whakatāne District Council will not be liable for any loss, damage, costs (for instance incurred in accepting or redeeming a prize) or any injury whatsoever suffered by an entrant as a result of or in connection with the competition.
  4. These terms and conditions were set in November 2018 and Whakatāne District Council reserves the right to amend or change them without notice at any time at its sole discretion, including extending, postponing or cancelling a competition.
  5. These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand and shall be subject to the non-exclusive jurisdiction of the New Zealand Courts.
